A federal judge on Wednesday rejected a lawsuit filed by a New Jersey woman who claimed the drug caused her to lose her hair while taking finasteride.
In a decision that's the first time in months that federal drug regulators have rejected a drug that was linked to baldness, U. S. District Judge William H. Souza of New Jersey issued a unanimous ruling in a lawsuit filed by a New Jersey woman who claimed she developed hair loss after taking a version of Proscar. The drug's manufacturer, Merck, said it did not have any evidence of its possible links to baldness.
In a separate order, Judge Souza granted Merck's motion to dismiss the case. He wrote, "Because there is no evidence of a causal relationship between Proscar and hair loss, a plaintiff may not use the drug as directed or for a purpose that would be clearly harmful to her health."
The New Jersey woman did not deny taking Proscar, but she argued that she developed "hair loss" while taking it due to the drug's side effect of lowering testosterone. She claimed that she could not use the drug to treat hair loss but instead could only take finasteride, a drug that has been linked to severe hair loss in men.
The plaintiff was given Proscar for the first time in 2004, but doctors said that Proscar did not cause her hair loss and that her doctor prescribed it to her as part of her treatment.
"It's a matter of law, but we do not have scientific proof to suggest that Proscar causes hair loss," said Dr. David P. Schondelmeyer, director of the U. Food and Drug Administration's Center for Drug Evaluation and Research.
Dr. Schondelmeyer said Proscar did not cause hair loss in any significant way, and that Proscar has been linked to serious side effects and increased risk of prostate cancer. He said he would not rule out the possibility that Proscar could have been associated with other conditions, including an increased risk of Alzheimer's disease.
SOUZA said he did not believe there was "an increased risk of prostate cancer," and that there was "little or no scientific evidence" that Proscar caused hair loss.
"If we were to say that Proscar caused hair loss, then we would have to conclude that it did not," said Schondelmeyer.
Judge Souza wrote that a "generalized understanding" that a drug could cause hair loss was "very unlikely" because of the drug's "limited impact on male sex characteristics," but that the "generalized understanding" that hair loss could occur without medication is "particularly likely."
The FDA says Proscar is approved for the treatment of benign prostatic hyperplasia (BPH), a condition that affects between 20 and 50 percent of men, but it's not clear if it also causes hair loss.
SOUZA did not comment on the case and has not made any statement to the press about the case.
"This case is not about the safety, efficacy, or the quality of life of anyone affected," he said.
